Terms of Service

1. Acceptance of Terms

By booking or paying for any service with LYTE Music, you confirm that you have read, understood, and agree to these Terms of Service. These terms govern all interactions with LYTE Music and apply to all clients and their guests.

2. Booking and Payment Policy

  • Bookings are confirmed only upon receipt of full payment upfront.

  • Payments are non-refundable under all circumstances.

  • Sessions must be paid in advance or by the due date on any invoice.

  • Your payment secures your time slot. If payment is not received we reserve the right to reschedule or cancel your session within 24 hours of the originally scheduled date.

  • We cannot provide refunds for no-shows or cancellations made within the 24-hour window.

  • We understand that situations can arise and may be flexible depending on the circumstances, so please reach out to us if any issues occur.

3. Refund Policy

  • All payments to LYTE Music are final.

  • There are no refunds for cancellations, change of mind, dissatisfaction with creative results, or any other reason.

  • By booking, you accept full responsibility for your decision to engage our services.

4. Rescheduling Policy

  • To reschedule, notify us at least 48 hours before your session. We will do our best to accommodate you, subject to availability.

  • Rescheduling requests within 48 hours may incur a fee of up to 50% of the session price.

  • Multiple reschedules may be refused at our discretion.

5. Session Punctuality & Timing

  • Late arrival does not extend your session time. Your booking period includes all setup, recording, packing up, and review time.

  • We appreciate your understanding that packing up will begin 10-15 minutes before the session concludes, ensuring we exit the studio promptly at the scheduled end time. This policy is in consideration of our other studio guests and the overall studio operations.

6. Conduct and Behaviour

  • LYTE Music upholds a professional and respectful atmosphere. Any form of verbal abuse, intimidation, or aggressive behaviour is strictly prohibited.

  • We reserve the right to terminate any session immediately for inappropriate conduct, without refund.

  • Clients are responsible for the behaviour of all their guests, and LYTE Music is not liable for any physical or non-physical damages incurred by any party.

7. Substance Policy

Strictly no smoking, vaping, alcohol, or illicit substances in any recording space.

Violation will result in immediate termination of the session at the discretion of LYTE Music & Affiliates, without refund and possible permanent refusal of future bookings.

8. Food and Drink

  • No food or open drinks are permitted near recording or mixing equipment.

  • Breaks for food and drink can be taken outside the studio space unless permitted otherwise by LYTE Music & Associated Studios.

9. Equipment and Care

  • Clients must treat all studio equipment with care and respect.

  • Reckless or negligent handling will result in liability for repair or replacement costs.

  • Any damage caused will be invoiced to the client in full.

10. Guest Responsibility

  • You are fully responsible for the behaviour of anyone you bring to a session.

  • Any damage, mess, or misconduct by guests will be treated as your responsibility.

11. Cleaning Fee

  • The studio must be left in a clean, tidy condition. A minimum cleaning fee of $50 may apply if additional cleaning is required due to your session.

12. Intellectual Property

  • All rights to creative works produced during sessions remain subject to separate agreements between you and LYTE Music.

  • No rights are transferred automatically by booking studio time.

13. Liability and Disclaimer

  • You use LYTE Music services at your own risk.

  • LYTE Music accepts no responsibility for dissatisfaction with creative outcomes. We strive for excellence, but final results are subjective.

  • We are not liable for any personal injury, loss, or damage arising during your session.

14. Force Majeure

  • LYTE Music is not liable for inability to provide services due to events beyond our reasonable control, such as natural disasters,  pandemics such as COVID-19 or any future outbreaks of similar nature, extended power outages, or other unforeseeable circumstances.

15. Overdue Payments

  • 15.1. All invoices are due and payable within thirty (30) days from the date of issue unless otherwise agreed in writing.

  • 15.2. If any payment remains outstanding after thirty (30) days, the Client acknowledges and agrees that:
    (a) The full outstanding balance shall immediately become due and payable in full, regardless of any agreed instalment arrangement; and
    (b) The account may be referred to an external debt collection agency without further notice.

  • 15.3. In the event of referral to a debt collection agency, the Client shall be liable for all reasonable recovery costs, collection fees, commissions, administrative charges, and legal expenses incurred in the process of recovering the debt. These fees will be added to the total outstanding amount.

  • 15.4. Where payment under an instalment arrangement is missed, the entire remaining balance shall be deemed immediately due and payable, and collection proceedings may commence for the total outstanding amount.

  • 15.5. The Company reserves the right to suspend or terminate ongoing work, delivery, or services until full payment (including all applicable recovery costs) is received and cleared.

16. Amendments

  • LYTE Music reserves the right to amend these Terms of Service at any time. Updated terms will apply to all future bookings.
